Terms and Conditions
These Terms and Conditions ("Terms") govern all reservations, stays, visits, and activities at Broken Arrow Wilderness ("BAW", "we", "us"). By reserving, entering, or using BAW property, facilities, accommodations, equipment, or services, you agree to these Terms.
1. Definitions: “Guest” means the person making the reservation and all persons in their party, including visitors. “Property” means all BAW grounds, structures, parking areas, river access points, and amenities. “Activities” include, without limitation, camping, swimming, and any river-related use of equipment (tubes, tanks, kayaks, canoes).
2. Reservations and Eligibility: Reservations are required for accommodations and any scheduled activities/services when offered.Minimum age to reserve is 19. Minors must be accompanied by a parent/guardian or adult chaperone as required by BAW policies.The person who makes the reservation is responsible for the full invoice and for their party’s compliance with these Terms. BAW may require a credit card on file upon arrival to cover incidentals, damages, cleaning, missing items, or policy violations.
3. Deposits, Payments, and Fees: A deposit may be required to confirm or hold a reservation. A reservation is not confirmed until payment is received.Deposits are non-refundable but may be transferable to a later date subject to BAW’s transfer policy and availability.Payment methods and any convenience fees are set by BAW and may change without notice.Returned checks may incur a fee.
4. Cancellations, No-Shows, and Changes: Cancellation and change policies vary by reservation type, season, and length of stay. The policy in effect at the time of booking applies and is provided during booking/confirmation. No-shows and early departures may be charged up to the full reservation amount.
5. Check-In, Check-Out, and Arrival Windows: Check-in/check-out times and arrival windows are communicated at booking and/or posted on-site. Late arrivals are not guaranteed without prior arrangements. If you expect to arrive outside posted hours, contact BAW in advance.
6. Property Use and Compliance with Policies: Guests must comply with all posted rules, instructions from staff, and all applicable federal, state, and local laws. BAW policies include, for example, conduct/quiet hours, visitor registration, parking, pet restrictions, smoking restrictions, fire safety, trash disposal, and activity-specific requirements. Policies exist to protect safety, the environment, and other guests.
7. Assumption of Risk: Outdoor recreation involves inherent risks, including uneven terrain, wildlife, weather, water currents, submerged objects, slippery surfaces, and potential injury or illness. You voluntarily assume all risks related to your stay and Activities, including risks arising from the actions of other guests or visitors.
8. Safety and Health: No lifeguard is on duty. Swim and recreate at your own risk.Guests are responsible for determining whether conditions (weather, river level/flow, personal health/ability) are suitable.Guests must follow all safety guidance and use required safety equipment (including any legally required life jackets). In an emergency, call 911 first, then notify BAW staff when safe to do so.
9. Damage, Cleaning, and Missing Items: Guests are financially responsible for damages, excessive cleaning, missing items, or unauthorized alterations to any BAW property, accommodation, equipment, furnishings, or grounds caused by the Guest or their party (including visitors and pets). BAW may charge the card on file or otherwise invoice the Guest for such costs.
10. Personal Property: BAW is not responsible for loss, theft, or damage to personal property, including vehicles and contents, except to the extent required by law. Guests should secure valuables at all times.
11. Equipment Use (If Applicable): If BAW provides or rents equipment (including river equipment), Guests must use it only as intended, follow all instructions, return items by required deadlines, and return items in the condition received (ordinary wear excepted). Late returns, loss, or damage may result in additional charges.
12. Refusal of Service and Removal: BAW reserves the right to refuse service, deny entry, or remove any person for unsafe behavior, illegal activity, noncompliance with these Terms or posted policies, or conduct that disturbs others. Removal may occur without refund and does not limit BAW’s right to recover costs for damages, cleaning, or other charges.
13. Limitation of Liability: To the maximum extent permitted by law, BAW’s total liability for any claim arising out of or related to a reservation, stay, or Activities is limited to the amount paid to BAW for the specific reservation or service giving rise to the claim. BAW is not liable for indirect, incidental, special, consequential, or punitive damages.
14. Indemnification: To the maximum extent permitted by law, you agree to indemnify, defend, and hold harmless BAW and its owners, employees, contractors, and agents from and against claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to (a) your stay or Activities, (b) your breach of these Terms or posted policies, or (c) your negligence or willful misconduct.
15. Changes to Terms: BAW may update these Terms or its policies at any time. The version in effect during your stay applies. Updated Terms may be posted on-site and/or on BAW’s website.
16. Governing Law and Venue: These Terms are governed by the laws of the State of Nebraska, without regard to conflict-of-law rules. Any dispute shall be brought in the state or federal courts located in Nebraska, unless a different venue is required by law.
17. Severability: If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force and effect.
18. Entire Agreement: These Terms, together with your reservation confirmation and any posted or provided policies referenced herein, constitute the entire agreement between you and BAW regarding your stay and Activities.
